Terms of Service

Last updated: 2026-09-10

These Terms of Service ("Terms") govern your use of CustomsScanner (the "Service") operated by Talya Global Lojistik Hizmetleri ("we", "us", "our"). By creating an account or otherwise using the Service you agree to be bound by these Terms.

What CustomsScanner is not

We are not a customs broker and we do not file customs entries. We are not a law firm, a licensed customs consultant, or a tax adviser, and nothing on the Service is legal, customs or tax advice.

Customs entries are filed by the licensed broker you select through the Service — in the United States, a broker licensed by U.S. Customs and Border Protection filing through ABI/ACE; in the European Union and United Kingdom, an established declarant holding a valid EORI number; and the local equivalent elsewhere. Your filing relationship, including the power of attorney, is between you and that broker. We introduce the parties, pass documents between them and report status.

Every duty, tax, fee and landed-cost figure on the Service is an estimate for planning purposes. Tariff classification is a legal determination that depends on facts about your goods that we do not independently verify. Duty rates, preference eligibility, de minimis thresholds and partner-agency requirements change without notice. You remain the importer of record and you remain responsible for the accuracy of your declarations. Verify any figure with your broker or the relevant customs authority — and obtain a binding ruling where certainty matters — before you rely on it.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. Accounts must be registered with accurate information and used by the person or organisation named at registration.

2. Accounts and security

You are responsible for safeguarding your password and for any activity that occurs under your account. Notify us at info@talyasmart.com immediately if you suspect unauthorised access.

3. The Service

CustomsScanner aggregates tariff schedules, duty and tax rates, HS classification reference material, customs broker metadata and entry-status signals from customs authorities and third-party data providers. The data is provided on a best-effort basis and may be incomplete, out of date or inaccurate. Subject to section 4 above, you agree to verify time-critical and legally significant information — classification, duty rate, preference eligibility, partner-agency requirements, release status — with your broker or the relevant authority before acting on it.

4. Brokers on the Service

We verify that a listed broker holds a valid licence in the jurisdictions it claims before it appears in our directory, and we re-check on a periodic basis. That verification is a check of licence status — it is not an endorsement, a guarantee of performance, and not a warranty that the broker's advice or filings are correct. Brokers are independent third parties, not our employees or agents. Your engagement with a broker, including its fees, its terms and any professional liability, is a direct contract between you and that broker.

5. Acceptable use

You agree not to:

  • Reverse-engineer, scrape or systematically download Service data beyond your subscription quota.
  • Resell, sublicense or re-publish tariff data, classification content or broker records without a written commercial agreement — some of this material is licensed to us and cannot be sublicensed.
  • Use the Service to import, broker or enable goods that are prohibited or restricted under applicable customs, export-control, sanctions or dual-use regulations, or to misdeclare goods, value, origin or classification.
  • Use the Service to evade duty, tax, quota, licensing or partner-agency requirements, or to structure shipments for that purpose.
  • Present our estimates to a customs authority, an insurer or a counterparty as a determination, a certification, or professional advice.
  • Probe, scan or test the vulnerability of the Service without written authorisation.
  • Use the Service in a way that overloads our infrastructure or degrades it for other users.

6. Fees: what we charge and what we pass through

Your subscription buys platform access only. Paid plans are billed monthly in advance and renew automatically until cancelled from your account billing page. Quotas (entries, classifications, duty estimates, entry-status checks) reset on the first day of each calendar month at 00:00 UTC.

Government duty, taxes and statutory fees are passed through to you at cost, with no markup by us. Broker fees are set by the broker; where we add a service margin on top of a broker's fee, that margin is disclosed as its own line item in the quote. Refunds for partial periods are not provided except where required by law.

Prices may change. We will give at least 14 days' notice for any price increase that affects your subscription, by email and through an in-app banner.

7. Subscriptions & cancellation

There is no free tier. All plans are paid and start at $2.99/month (Starter). You may cancel at any time from your billing page — cancellation stops future renewals, and your access continues until the end of the current paid period. We do not provide pro-rated refunds for partial months. We may rate-limit, suspend or withdraw access without notice if we detect abuse, automation, sustained over-quota use or fraudulent payment activity. We will not cut off status access to an entry that is already mid-clearance.

8. Intellectual property

CustomsScanner, the CustomsScanner mark, the platform UI, brand assets, code, documentation and the curated databases we maintain (broker registry, port-of-entry registry, classification annotations) are our intellectual property or that of our licensors. Tariff nomenclature and schedules remain subject to the rights of their issuing bodies and our licensors; broker names, licence numbers and trademarks remain the property of the respective brokers and are used for informational reference only.

9. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by applicable law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted availability. We do not warrant that any classification, duty rate, landed-cost estimate or preference determination surfaced by the Service is correct, current or accepted by any customs authority, nor that the Service will be error-free or that the underlying tariff and status data will be complete.

10. Limitation of liability

To the maximum extent permitted by applicable law our aggregate liability arising out of or related to the Service will not exceed the greater of (a) the fees you paid us in the twelve (12) months immediately preceding the event giving rise to the claim or (b) one hundred US dollars (USD 100). We are not liable for indirect, incidental, special, consequential or punitive damages, including loss of profit, cargo, revenue, goodwill or data — and specifically not for duty or tax underpayments, penalties, liquidated damages, seizure, storage or demurrage costs, delayed release, or any fine or assessment levied by a customs or partner agency.

11. Termination

You may cancel your account at any time from the billing page or by emailing us. We may suspend or terminate your account if you breach these Terms, if your payment fails after reasonable notice, or if continuing to serve you would expose us to legal risk. On termination you lose access to paid features; we will keep records we are required to retain for the period required by law and then delete them.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by email or a prominent in-app banner at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

13. Governing law and venue

These Terms are governed by the laws of the Republic of Türkiye. Any dispute that cannot be resolved through good-faith negotiation will be submitted to the exclusive jurisdiction of the courts and execution offices of Istanbul (Çağlayan), Türkiye.

These Terms summarise the legal relationship between you and us in plain language. They are not legal advice — if you have questions about how they apply to your situation, consult a qualified attorney or a licensed customs broker.
